Important: Please read these Terms of Service carefully before using Neighboard. By accessing or using our services, you agree to be bound by these terms.

Horseback Riding Liability Disclaimer

WARNING: HORSEBACK RIDING IS INHERENTLY DANGEROUS

Horseback riding, horse-related activities, and interactions with horses carry inherent risks of serious injury or death. By using Neighboard to find equestrian businesses and services, you acknowledge and accept these risks.

Your Responsibilities

When participating in horseback riding or equestrian activities found through Neighboard, you agree to:

  • Verify insurance coverage: Confirm that the business has adequate liability insurance
  • Sign waivers: Complete any liability waivers required by the business
  • Follow safety instructions: Obey all rules, instructions, and safety guidelines provided by the business
  • Use safety equipment: Wear appropriate safety gear including helmets when required or recommended
  • Disclose health conditions: Inform the business of any medical conditions that may affect your safety
  • Exercise good judgment: Do not participate if you feel unsafe or uncomfortable
Neighboard's Role

Neighboard is a directory and marketplace platform only. We do not:

  • Operate, manage, or control any listed businesses
  • Employ or supervise instructors, guides, or stable staff
  • Own, maintain, or inspect horses, facilities, or equipment
  • Guarantee the safety, quality, or legality of any services
  • Verify insurance coverage, licenses, or certifications
  • Assume any liability for injuries, accidents, or damages that occur at listed businesses

YOU PARTICIPATE IN HORSEBACK RIDING AND EQUESTRIAN ACTIVITIES AT YOUR OWN RISK. Neighboard is not responsible for any injuries, accidents, property damage, or death that may occur.

1. Acceptance of Terms

By accessing or using Neighboard ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

Eligibility

You must be at least 13 years old to use Neighboard. If you are under 18, you must have parental or guardian consent to use the Service.

2. Business Listings & Information Accuracy

Business information is provided by business owners, users, or third-party sources. Neighboard does not independently verify all information and makes no representations or warranties about the accuracy, completeness, or reliability of business listings.

Your Responsibility to Verify

Before engaging with any listed business, you should:

  • Verify business details directly with the business (hours, pricing, services, availability)
  • Confirm insurance coverage and licensing
  • Read reviews and ratings, but make your own independent assessment
  • Visit the facility in person before committing to services
  • Ask about safety records, instructor qualifications, and emergency procedures
Business Verification

Some businesses display a "Verified" badge. This badge only confirms that the business owner has verified ownership of the listing. It does NOT constitute:

  • An endorsement or recommendation by Neighboard
  • A guarantee of quality, safety, or service standards
  • Verification of insurance, licenses, or certifications
  • A warranty of any kind

Always conduct your own due diligence before engaging with any business.

3. User Conduct & Prohibited Activities

When using Neighboard, you agree NOT to:

Prohibited Content
  • Post false, misleading, or defamatory reviews or information
  • Post content that violates intellectual property rights
  • Upload photos you do not own or have permission to use
  • Post spam, advertisements, or promotional content
  • Share personal information of others without consent
  • Post hate speech, threats, or harassing content
  • Post illegal, obscene, or offensive content
Prohibited Behavior
  • Impersonate any person or entity
  • Create multiple accounts to manipulate reviews or ratings
  • Use automated tools (bots, scrapers) to access the Service
  • Attempt to hack, disrupt, or compromise the Service
  • Violate any applicable laws or regulations
  • Harass, threaten, or discriminate against other users
Enforcement

Violations may result in:

  • Content removal
  • Account suspension or termination
  • Legal action (for serious violations)

4. User-Generated Content & License

When you post reviews, photos, comments, or other content ("User Content") to Neighboard, you retain ownership of your content. However, you grant Neighboard the following rights:

License Grant

You grant Neighboard a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable license to use, display, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute your User Content in connection with the Service.

This means we can display your reviews and photos on our website, in emails, in marketing materials, and allow others to share them. You still own your content, but give us permission to use it.

Your Representations

By posting User Content, you represent and warrant that:

  • You own the content or have all necessary rights and permissions
  • The content does not violate any intellectual property rights
  • The content does not violate any laws or these Terms
  • The content is accurate and not misleading
Review Guidelines

Reviews must be based on your personal experience. Reviews should be:

  • Honest: Based on actual experiences
  • Relevant: About the business and its services
  • Respectful: No profanity, threats, or personal attacks
  • Fair: Balanced and constructive feedback
Note: Neighboard may remove reviews that violate our policies or applicable laws, but we are not obligated to monitor or remove User Content.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEIGHBOARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Injuries or death occurring at listed businesses or during equestrian activities
  • Property damage caused by horses, facilities, or equipment
  • Inaccurate business information provided by businesses or users
  • Business conduct including fraud, negligence, or illegal activities
  • Quality of services provided by listed businesses
  • Indirect, incidental, special, consequential, or punitive damages of any kind
  • Loss of profits, revenue, data, or use arising from your use of the Service
  • Third-party actions including other users or businesses

IF WE ARE FOUND LIABLE DESPITE THESE LIMITATIONS, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Neighboard disclaims all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of content
  • Warranties that defects will be corrected

USE OF THE SERVICE IS AT YOUR OWN RISK. You are responsible for implementing safeguards to protect your data and devices.

7. Indemnification

You agree to indemnify, defend, and hold harmless Neighboard and its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your User Content
  • Your interactions with listed businesses
  • Your participation in horseback riding or equestrian activities

8. Dispute Resolution & Arbitration

Informal Resolution First

Before filing any claim, you agree to try to resolve the dispute informally by contacting us at legal@neighboard.com. We will attempt to resolve the dispute informally within 60 days.

Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute will be resolved through binding arbitration, not in court. Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class Action Waiver

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes must be brought on an individual basis only.

Jury Trial Waiver

YOU WAIVE YOUR RIGHT TO A JURY TRIAL. Any disputes not subject to arbitration will be resolved by a judge without a jury.

Exceptions

Either party may bring claims in small claims court if they qualify.

Important: You have the right to opt out of arbitration. To opt out, send written notice to legal@neighboard.com within 30 days of first accepting these Terms.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of [Your State], without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in [Your County/City, State].

10. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, for any reason including violation of these Terms.

You may terminate your account at any time by contacting us or using account settings. Upon termination, your right to use the Service ceases immediately.

Sections that survive termination: Limitations of Liability, Disclaimers, Indemnification, Dispute Resolution, and any other provisions that by their nature should survive.

11. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and Neighboard.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Neighboard's failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not assign these Terms. Neighboard may assign these Terms without restriction.

Third-Party Services

The Service may contain links to third-party websites or services. Neighboard is not responsible for third-party content or practices.
